I had a conversation with Kim recently and at one point in the conversation, he suggested I ask my question to you for a response.


I asked Kim and now I am asking you, how it it that the City is allowing the development as proposed the the LDS Church when the City has been put on notice that the proposed development VIOLATES a contractual commitment they made with Beesmark, LLC?


According to the special warranty deed signed between the LDS Church and Beesmark, LLC, the contractual obligation and legal commitment the two parties made REQUIRES them to build a family search and discovery center on the southern border of the property, NOT A LDS STAKE CENTER!


Is a LDS (church) even a permitted use within the resort community zone?


Section 28.010 Purpose and Intent.

Capture previously unreachable tax revenues by
providing an incentive and attraction for business own-
ers and retail operators from outside the State to locate
in the new destination community of Lehi City.


I would suggest that the city of Lehi is not following its own code.  Section 28.010 (c), clearly emphasizes that the purpose of the resort community is to "capture unreachable tax revenues by providing an incentive and attraction for BUSINESS OWNERS and RETAIL OPERATORS from OUTSIDE THE STATE (why is it so difficult for the city to follow its own code?)".


Will the LDS Stake Center provide the city with unreachable tax revenue?  How will the city identify the proposed family search and discovery center from a tax basis?  Is the city providing an incentive for a business owner WITHIN the State to locate in the resort community? 

Why is the city ignoring this provision of the code and allowing MOSTLY business owners and retail operators from within the State to locate in the resort community?
