Ally, Brent and Nathan

Here is a recent blogpost regarding the creation of the Family Search site.
I will continue to document this project every step of the way.

Shame on the LDS Church for creating the Family Search plat without any public notice or involvement.  Todd Munger, a LDS Church member, former BYU employee and BYU graduate had NO business signing off on the creation of the Family Search Plat, he was NEVER in a single recorded meeting discussing the site, that is right, not a single meeting, yet he signed off on the plat. All done in secret to make sure NO ONE from the community knew what the HELL the LDS Church was up to.

I think you might want to read a number of other blogpost I have written, many having to do with the Presiding Bishop and his counselors  and honoring their commitments (Special Warranty Deed signed between the LDS Church and Beesmark).

Not only was the Family Search plat created in secret, it is recorded improperly at Utah County and the First Presidency is breaking their contractual commitment to build a Family Search Discovery Center on the Southern Border of the site.

Do you really expect any of the members in the LDS Church to honor their commitments to one another when the Presiding Bishop and his counselors can't even honor their commitments?
I now know why Utah County (predominately LDS) has one of if not the highest white collar fraud statistics in the country, they have learned that honoring their commitments means nothing from their LDS Church leaders.

Why don't you find out how many other subdivisions Gary Smith and Todd Munger have signed off on behalf of the Lehi City Council, the answer would be more than likely NONE, just the Family Search Plat and they couldn't even do that right. (plat versus metes and bounds, chapter 28).
This story will eventually go national and when it does and they discover my blog, holy smokes, the LDS Church and its representatives are not going to look good.

This whole situation makes me sick.  I personally have had over 10 LDS Temple worthy LDS Church members attempt and in some case successfully defraud me out of millions of dollars, they call it affinity fraud and I was such a sucker.  Where did those LDS Temple worthy church members learn how to defraud their neighbor? Church leaders?

This story must continue to be told, it truly is amazing and an abomination. It goes to show what lengths the LDS Church will go to make money.

It is definitely time the City of Lehi Utah to appoint, select or hire an Ombudsman

It is definitely time for the City of Lehi to appoint, select or hire and Ombudsman. Lehi has grown dramatically in the past several years and expects that growth to continue for many years to come. Most cities of Lehi's size have an Ombudsman.

What is an Ombudsman and what is their role?

Here is the Merriam-Webster definition:

  1. a government official appointed to receive and investigate complaints made by individuals against abuses or capricious acts of public officials;one that investigates, reports on, and helps settle complaints.
Wikipedia defines the role and responsibility of an Ombudsman as follows:
An ombudsman or public advocate is usually appointed by the government or by parliament, but with a significant degree of independence, who is charged with representing the interests of the public by investigating and addressing complaints of maladministration or a violation of rights. In some countries an Inspector General, Citizen Advocate or other official may have duties similar to those of a national ombudsman, and may also be appointed by a legislature. Below the national level an ombudsman may be appointed by a state, local or municipal government. Unofficial ombudsmen may be appointed by, or even work for, a corporation such as a utility supplier, newspaper, NGO, or professional regulatory body.
The typical duties of an ombudsman are to investigate complaints and attempt to resolve them, usually through recommendations (binding or not) or mediation. Ombudsmen sometimes also aim to identify systematic issues leading to poor service or breaches of people's rights.
In politics:
In general, an ombudsman is a state or local official appointed to provide a check on government activity in the interests of the citizen, and to oversee the investigation of complaints of improper government activity against the citizen. If the ombudsman finds a complaint to be substantiated, the problem may get rectified, or an ombudsman report is published making recommendations for change.
The major advantage of an ombudsman is that he or she examines complaints from outside the offending state or local institution, thus avoiding the conflicts of interest inherent in self-policing. However, the ombudsman system relies heavily on the selection of an appropriate individual for the office, and on the cooperation of at least some effective official from within the apparatus of the state or local community (county, city, town or municipality)
Why does the City of Lehi need an Ombudsman?
Right now, complaints to the City of Lehi fall on deaf ears.  The City is self policing itself and there is no one at the City looking after the interest of the citizens of Lehi.  Hundreds of complaints are directed towards the city with no central person or organization receiving these complaints, looking into them and getting back to the resident who filed the complaint.  The city is operating on the good old boy network and looks after its own best interest rather than the interest of the citizens (who by the way pay their salaries).  The city is failing to enforce and adhere to its own city code without consequence.
Right now, citizen complaints are merely a distraction and NOT taken seriously by anyone in city government.  You can complain all you want and no one seriously cares what you think.
An Ombudsman is a citizen advocate.  Complaints about or against the city would be sent to the Ombudsman who would look into the complaint and get back to the citizen.  Right now, if your complaint is even heard, rarely does anyone from the city get back to you and rarely does anyone at the city look into your complaint.

Right now, there are no checks and balances in the city.  City employees, officials and administrators do whatever they want without consequence.  Nobody is holding them responsible or accountable for performing their job in the best interest of the citizens.
To be blunt, those who work for, appointed or elected to positions in the city are out of control and are not being held accountable for their damaging behavior.  The health, safety, long term welfare of the citizens of the city of Lehi are put in jeopardy every day by those who suppose to be protecting their interest.
It is time for the City of Lehi to appoint, select or hire an Ombudsman.  If they don't, it indicates to me that they want to continue to run the city without oversight and in their best interest and not the interest of the citizens.

Todd Munger, the fix was in for the LDS Church and the creation of the Family Search Plat

Todd Munger went to BYU from 1987 -1991.

He began working for BYU in April, 1990 and was employed by BYU thru May of 2008, 18 years and 2 months.

No doubt Todd is a member of the Church of Jesus Christ of Latter-day Saints.

Todd currently works for the City of Lehi as the Public Works Director.  Todd along with Gary Smith (Chief Building Inspector for the City of Lehi) signed off on behalf of the Lehi City Council creating the Family Search Plat.

 Family Search Plat

What I am about to tell you is critically important.  Todd Munger signed his name on the creation of the Family Search site without ever attending a single recorded meeting discussing the Family Search site.  Todd signed his name to the creation of the plat without knowing anything about it!

WOW!!!!!!!!!

Can you say the fix was in.  Todd went to BYU, worked for BYU and is more than likely a member of the Church of Jesus Christ of Latter-day Saints.  He signed a document he knew nothing about BECAUSE the Family Search site, a single lot subdivision is owned by the Church of Jesus Christ of Latter-day Saints.  A Church where Todd is a member and where he worked and where he went to college.

Hmmmmmmmmmmmm, do you think Todd put the interest of the Church he is a member of before his civic responsibility to the citizens of Lehi??????????? Of course he did.

In FACT, when I questioned Todd about signing off on the creation of the Family Search site, a site he knew nothing or very little about.  He indicated he signed off on the site because it was a LDS Church project and every thing the LDS Church did was first class.

So there you have it.  Todd Munger, Public Works Director and Gary Smith, Chief Building Inspector signed off on the creation of the Family Search site without any recorded input from the Lehi City Council or the Lehi Planning Commission, both of which normally sign off on the creation of a subdivision. What are they doing signing off on a subdivision, that is the responsibility of DRC, planning commission and city council, not a public works director and building inspector.

I have asked the City of Lehi to provide me with the names of any other subdivisions that Todd and Gary signed off on behalf of the Lehi City Council. To date, they have refused to provide me with any names, probably, because there are no other subdivisions that Gary and Todd have signed off on.

I have asked the City to verify that the signature on the Family Search site is indeed Todd's and they have refused to confirm or deny that the signature on the Family Search plat is actually Todd's and not a robo signature, which I contend.  I have asked Todd to verify his signature and he also refuses to provide me evidence that the signature on the Family Search site is his actual signature and not a robo signature.

I do not know if Gary Smith is a member of the Church of Jesus Christ of Latter-day Saints.  But if he is, it is further evidence the fix was in for the creation of the Family Search plat without any input from the Lehi City Council, Planning Commission or Lehi Citizen input.

This was all done in secret!!!!!!!!!!!!!!!!!

The Church did not want the citizens of Lehi knowing what they were doing.
The City of Lehi did not want the citizens of Lehi knowing what they were doing.

This project was meant to be hidden from the public and the City of Lehi was more than willing to accommodate the LDS Church in keeping the creation of the Family Search site a secret. Thus the reason Todd Munger and Gary Smith signed off on the Family Search site. That way they would be no public discussion, no public notice and no public involvement.  The LDS Church could create a subdivision without anyone knowing anything about it. That is truly disturbing and unbelievable.

To top it off, the Family Search site is recorded improperly at Utah County.  It should be recorded using metes and bounds and not as a plat.

Here is the relevant code:

City of Lehi CHAPTER 28 RESORT COMMUNITY ZONE (RC)

Section 28.080. Development Approvals and Permits.

The lots in a minor subdivision will be divided by a metes and bounds document rather than a plat.
See Wikipedia description of a plat vs metes and bounds below.

Todd Munger and Gary Smith should not have signed off on the creation of the Family Search site.
The plat is recorded improperly at the Utah County.

The fix was in on the creation of the Family Search site for a number of different reasons, but one in particular that is most obvious.  Can you guess what it is?

The Church of Jesus Christ of Latter-day Saints!!!!!!!!!!!!!!!

Todd Munger, shame on you for signing off on the creation of the Family Search site.  Just because you are a member of the LDS Church, went to college at the LDS Church University and worked for them for over 18 years does not give you the right to put the interest of the LDS Church before the citizens of the City of Lehi. Your civic responsibility trumps your church membership. You had no business signing off on this subdivision, a subdivision you knew nothing about just because you were a church member.

I have told the City of Lehi a number of times to fix the error in their recording at Utah County using the designation of a plat vs metes and bounds, they just don't seem to care. This must be done!

What does that say about the City of Lehi and those who work for the City?  They will do whatever it takes to put through a development by the LDS Church that nobody wants.

What organization in their right mind takes a perfectly good PGA caliber driving range and destroys it and replaces it with a commercial development?  INSANE!

Worse than a perfectly good driving range being destroyed is the FACT that 10's of thousands of cars will be added to residential streets each week.

The health, safety and long term welfare of the citizens who live in the area is being put at risk so a multi billion dollar developer can build more commercial office space.

Commercial buildings do not belong in a residential neighborhood!!! There is plenty of space for this project east of the rail road tracks where ALL the other commercial development has taken place.

Shame on you LDS Church.  Your selfish interest is hurting all those who live in the area.

Plat - A plat (/ˈplæt/[1] or /ˈplɑːt/)[2] in the United States (plan or cadastral map) is a map, drawn to scale, showing the divisions of a piece of land. United States General Land Officesurveyors drafted township plats of Public Lands Surveys to show the distance and bearing between section corners, sometimes including topographic or vegetation information. City, town or village plats show subdivisions into blocks with streets and alleys. Further refinement often splits blocks into individual lots, usually for the purpose of selling the described lots; this has become known as subdivision.
After the filing of a plat, legal descriptions can refer to block and lot-numbers rather than portions of sections.[3] In order for plats to become legally valid, a local governing body, such as a public works department, urban planning commission, or zoning board must normally review and approve them.

Metes and bounds - Metes and bounds is a system or method of describing land, real property (in contrast to personal property) or real estate. The system has been used in England for many centuries, and is still used there in the definition of general boundaries. By custom, it was applied in the original Thirteen Colonies that became the United States, and in many other land jurisdictions based on English common law.[1]
Typically the system uses physical features of the local geography, along with directions and distances, to define and describe the boundaries of a parcel of land. The boundaries are described in a running prose style, working around the parcel in sequence, from a point of beginning, returning to the same point; compare with the oral ritual of beating the bounds. It may include references to other adjoining parcels (and their owners), and it, in turn, could also be referred to in later surveys. At the time the description is compiled, it may have been marked on the ground with permanent monuments placed where there were no suitable natural monuments.
  • Metes. The term "metes" refers to a boundary defined by the measurement of each straight run, specified by a distance between the terminal points, and an orientation or direction. A direction may be a simple compass bearing, or a precise orientation determined by accurate survey methods.
  • Bounds. The term "bounds" refers to a more general boundary description, such as along a certain watercourse, a stone wall, an adjoining public road way, or an existing building.

Choose the Right, a wonderful LDS Church hymn that exposes the virtues and teaches our children the importance of choosing the right in ALL things great and small

Choose the right

Choose the right when a choice is placed before you
In the right the Holy Spirit guides;
And its light is forever shining o’er you
When in the right your heart confides

Choose the right! Let no spirit of digression
Overcome you in the evil hour
There’s the right and the wrong to every question
Be safe thru inspiration’s power

Choose the right! There is peace in righteous doing
Choose the right! There’s safety for the soul
Choose the right in all labors you’re pursuing
Let God and heaven be your goal

Chorus

Choose the right! Choose the right!
Let wisdom mark the way before
In its light, choose the right!
And God will bless you evermore

Text: Joseph L. Townsend

Music: Henry A. Tuckett

Commentary:

I hope the adults who were raised in the LDS Church and sang this song hundreds of times as children remember the importance of choosing the right in all things great and small.

I would also hope those who work for the  LDS Church and who instructs our youth to sing this song and abide by this virtue and adheres to the principle being taught.

Better to live in light than darkness. Better to be honest, honor your commitments, obey the law. live with integrity and practice what you preach.  If the LDS Church is going to encourage our youth to choose the right, those who work for the the LDS Church must too choose the right.  Otherwise they are hypocrites and are no better than those who live in darkness and have no understanding of the teachings of Jesus Christ.

For all of you who are involved with the Family Search plat in any capacity (LDS Church, Beesmark, City of Lehi) and are LDS, best for you to Choose the right as the song instructs.

If you have difficulty understanding the difference between right and wrong in this situation, then perhaps you may be living in darkness and the Holy Spirit has left you and you are unable to hear the voice of the Lord. Perhaps!

In case you are wondering.  I firmly believe that the proposed concept plan put forth by the LDS Church on the Thanksgiving Driving Range violates the Special Warranty Deed signed by Beesmark LLC and the LDS Church.

Take a look at the proposed concept plan put forth by the LDS Church and the exact language in the Special Warranty Deed and you be the Judge.

Question?  Does the proposed concept plan put forth by the LDS Church match the language in the Special Warranty Deed signed by the LDS Church and Beesmark?

I emphatically say NO!!!!!!!! You be the judge.

After reviewing these documents, feel free to leave a comment. What am I missing?  Does the Special Warranty Deed not clearly define what can be built?  If so, why is the LDS Church proposing to build something entirely different than what they contractually agreed to build?

Springville, Lehi pay fines for polluting water

Springville, Lehi pay fines for polluting water

The cities of Lehi and Springville will pay fines to the Utah Department of Water Quality for water pollution issues that occurred in 2014 and 2015.
A power spike in Springville on Nov. 2, 2014 shut down the city’s electronic monitoring system. As a result, an estimated 24,633 gallons of untreated waste water were discharged from a pumping station before the city could fix the problem.
The sewage flowed via storm drain to Spring Creek, eventually ending up in Utah Lake, according to the penalty calculation documents.
Springville reported the incident to the Division of Water Quality the same day. The settlement requires the city to pay a $100 fine, as well as fund a $5,567 mitigation project.
The mitigation project will have nothing to do with the equipment that caused the leak in the first place.
“It (the project) cannot deal with what happened. That would just be a reimbursement of the problem,” said Walt Baker, director of the Utah Division of Water Quality.
Instead, the mitigation project must be a Supplemental Environmental Project, which Springville cannot use to “generate any positive publicity” or “attempt to obtain a tax benefit from the foregoing funding of the mitigation projects,” according to the agreement.
However, Springville is working on a design for a larger “wet tank” to hold the sewage. That way, in a similar situation, there would be more time to fix the problem before overflow occurred into a waterway, said Bradley Stapley, public works director for Springville.
“We’re designing it right now, and will put it into the upcoming budget,” Stapley said.
Lehi’s water pollution incident occurred last July. The city's settlement included only a $2,200 fine that is paid to the State of Utah’s general fund, Baker said.

The fine was for discharging solids into Dry Creek as a result of well-drilling operations.
“You’re going to purge a bunch of sediment. That comes with the package when you develop a new well,” Baker said.
A complaint was filed about the discharge in the stream. When the Division of Water Quality came to investigate, it found city workers were not using means of filtering solids out of the water before the discharge entered the stream.
A discharge of that sort can negatively impact the fish in the stream, Baker said.
Lehi was able to implement use of a sediment pond to help filter the water and resume operations digging the well, the agreement said.
The Lehi Public Works Department is closed on Fridays and employees could not be reached for comment.
Commentary:  Todd Munger is the Head of Public Works for the City of Lehi.  Isn't he the same person who signed off on the Family Search Plat without even attending a single recorded meeting discussing its creation before he signed off on it.

Honor your commitments, the LDS Church, Beesmark and those who work for, are elected or appointed to positions at the City of Lehi, UT

Here is a little snippet of an E book I wrote on honoring your commitments.  I thought it relevant for those who work for the LDS Church, Beesmark and those who work for, are elected or appointed to positions at the City of Lehi, UT to read a little of what I wrote.

The bottom line:  Heavenly Father wants all us to honor our commitments with one another.  When we don't we live in darkness (we are following Satan), when we do, we are live in and are guided by the light (We are following Jesus).

I hope you enjoy reading this, at the end, I encourage you to reach out and contact me.

Wouldn’t it seem logical?

It sounds so logical (marked by consistent reasoning, reasonable, rational) that each of us would desire to have a golden reputation, to be a person others could always count on, a person who was trusted, respected, revered (to regard with great devotion or respect), a person known to be able to get the job done, done right, done on time, done professionally, a person others could always count on, depend on, come to in a time of need. A person who never lied, fabricated, rationalized, justified, wavered, told the truth in all circumstances (tells it like it is) didn't mince words, deceive, confuse, distort or misguide. It seems logical to tell the truth and never lie under every circumstance. So why don’t we do it? Why do we lie? Fall down on our word, disappoint others, leave others waiting for us, don't finish what we have started, and mislead people into believing what is not true as we rationalize – we are just protecting their feelings. Why do we tell half-truths, only part of the story, or mix and mince our words to cover what really happened? Why do we need to choose our words carefully, be cautious of the impression we are attempting to cultivate? How can we justify after we have made a commitment, to not call, write, or meet with others? What makes us so special, the center of the universe that we believe we are entitled to lie, cheat, steal, misinform, disengage, justify and rationalize our every thought, word and action – of course as it relates to us?

People want to hear the truth, the whole truth and nothing but the truth

People want to associate with those that they can count on, who are responsible, trustworthy, dependable, honest, forthright, sincere, loving, kind, committed, genuine, straightforward, an open book, happy, positive, driven, successful, humble. So why aren’t we all these qualities listed above? Why do so many of us say we are going to call, do something, meet someone at a specified time, commit our self to a certain activity and then fail to honor that commitment? One word –

Darkness – having little or no light, dismal, gloomy, difficult to comprehend, obscure. Unenlightened, ignorant, absence of light. Wicked, sinister.

The opposite of darkness is..

Light– brightness, enlightenment, understanding. A prominent person.

1.    The illumination from a source of light. A way of looking or considering something.

People believe that their survival in this world is more important than those around them. Many of us commit to someone or something never intending to honor that commitment. What we are attempting to do is pacify, put off or delay another in order to confuse, distort, distract and give them a sense of false hope.
We go around telling others what we believe they want to hear. The problem with this is that we are not telling the truth, we are not honest with others and eventually the light will shine on our every thought, word and deed. Do unto others as you would have others do unto you. People believe they are entitled to live in the darkness, to think about themselves first, to rationalize and justify their words and actions. The truth of the matter is, this couldn’t be further from the truth.

Can an honest man lie? If he lies he is NOT an honest man

Earlier I asked the question why men fail to honor their commitments. I then said one word, darkness. Many people never intend to honor their commitment when they made it. They may have had good intentions of honoring knowing full well that if they did not honor their commitment, they would be forgiven or that they can convincingly rationalize or justify the dishonoring of that commitment. Every time we do not honor our commitment, we tell a lie, a half-truth, people lose trust and faith in us. The effect of repeated acts of not honoring our word or our commitment to action leads to stronger and stronger feelings of distrust until eventually the other person has no trust in us at all, wants to flee the situation. Every act is cumulative, our actions may be forgiven, however they are never forgotten. When you dishonor your commitment by breaking it, others will look for a repeated behavior, for none of us enjoys being disrespected. Once we break any act, others will be on guard for the next time and the next time and the next time. Believe me when I say, they will keep track and learn what your true character, true nature is all about. Who and what you are will always come into the light. Others will come to know you for who and what you are, they will then make a decision to retain you as their friend, worker, teammate, husband or wife. For some of us it takes longer to make that decision.

Remember, it takes a fool to know a fool.

People who live in darkness have a tendency to surround themselves with others who reside in darkness. People who live in the light and truth surround themselves with others who live in the light and truth. Those who live in darkness and continue to live in darkness that surround themselves or associate with those who live in the light will have their darkness revealed.
We will always get what we deserve. Light for light, truth for truth, darkness for darkness, pain for pain, joy for joy, sorrow for sorrow, misery for misery.

They say that misery loves company

Remember to never bite off more than you can chew, don’t over commit, don’t ever make a commitment you are incapable, unable, unwilling, unmotivated, never intend to keep. Your best intentions may prove to be your worst nightmare. Where there is light there is an absence of darkness and where there is darkness there is an absence of light. You can’t have light and darkness at the same time. You can have varying degrees of light and darkness and that is how most of us live our lives, in varying degrees of light and darkness.

We started off earlier by discussing a person’s honor. Remember never to commit to that which you are incapable, unwilling, unable, don’t intend to honor. Be men and women of your word, live in truth and harmony, avoid conflict by living in the light, honor your commitments, build trusting relationships, structure your time and your life around serving others, never ever lie, tell a half truth, mince words or embellish or fabricate. Remember to always tell the truth, honor your commitments, be reliable, dependable and straightforward.
