Attention all builders, contractors and Developers, Lehi City wants you to know you DO NOT need a grading permit if you have site plan approval from the Planning Commission

All Contractors, builders and developers who have a building project in the City of Lehi, UT.
If you have site plan approval from the City of Lehi Utah Planning Commission
You can ignore
Chapter 12-b
Grading permit Requirements
You don’t need to follow it.
You can ignore it.
It is no longer needed to begin grading, excavating or grubbing your construction site.
Whether you are grading .25 acres or 500 acres, as long as you have site plan approval by the Lehi Planning Commission, you are free to grade away.
You do not need a grading permit.
According to Ryan Wood, Lehi City Attorney
11.300 states “following the approval of Site Plan with the City the developer/owner may proceed with construction.”

No grading permit required, grade and excavate away, to your hearts content.
You no longer need a grading permit;
no more hassle with staking your project, no more hassle with accounting for dump truck trips, no city supervision by the street department, no longer do you need to keep your grading permit on site, no longer to you have to provide them with any data as required in Chapter 12-b.
Forget 12-b, it doesn’t apply to you if you have site plan approval from the Lehi City Planning Commission.
Excavate and grade away.  Feel free to do what you want to your property, it literally does not matter to the City.
Don’t let them fool you into thinking you need a grading permit; you don’t as long as you have site plan approval from the Planning Commission. 

No longer to you need a building permit to proceed, grade and excavate away, no problem, no questions, no supervision, no worries.
You see, I have been in contact with the With Ryan Wood, Lehi City attorney. I was concerned that the Thanksgiving Point Driving Range was being grubbed, graded and excavated without a proper permit according to 12-b.  Ryan Wood informed me that contractors, builders and developers DO NOT need a grading permit as required in Chapter 12-b as long as you have site plan approval from the Planning Commission.  You don’t even need to go before the City Council. Whether your project is .25 acres or 500 acres, know this - you DO NOT need a grading permit.

In fact the only time you need a grading permit in the City of Lehi, Utah according to Ryan Wood; “That Chapter (Chapter 12-b) ONLY applies to projects where the developer wants to do grading only and doesn’t have Site Plan approval.”
So if all you are going to do is grade a parcel and don’t have site plan approval, you, according to Ryan Wood, need a grading permit. Otherwise, site plan approval in hand, grade, excavate, grub away.  Don’t worry about soil erosion or anything else for the matter.  Ryan Wood has said, you don’t need to follow or abide by Chapter 12-b.  Looks like you NEVER need to get a grading permit, so don’t concern yourself with that nasty paperwork. 
Drive by the Thanksgiving Point Golf Course Driving Range and check out what they are doing, all without a grading permit. Ryan never indicated that a contractor, developer or builder would ever require a grading permit and how could he when the work has already been done.
Public works, forget about them, you don’t need to go through them to get a grading permit.

By the way, I absolutely and boldly disagree with Ryan Wood. I believe that you need a grading permit if your project is 1 acre or above and I also believe that if your project is 10 acres or more, you need Planning Commission and City Council approval for your grading project. After you have received their approval, then and only then can you go to public works and possibly receive grading permit approval.
But, hey, what do I know, Ryan Wood says grade away. 

Keep reading from time to time I will let you know what other Lehi City Land Development Codes you can ignore. Know this, you probably never have to provide all the information they request in the permit applications.  They seem to approve permits ALL THE TIME without all the required documents. You might want to ask the city which documents they REALLY need and which ones you can skip giving them. Who wants to do all that paperwork.
